TERMS & CONDITIONS

Memorandum of Agreement for Materials Submitted

to www.myelevatorpitchforgod.com (mepfg.com)

           This contract (the “Agreement”) is made between My Elevator Pitch For God (mepfg.com), located at P.O. Box 313, 160 Alamo Plaza, Alamo CA 94507-9998, hereinafter referred to as the Publisher, and you (the submitter), an individual as presented in the Submittal Form, hereinafter referred to as the Author.

In consideration of mutual promises and forbearances expressly stated herein, the parties agree as follows:

​

1.        Author’s Grant.

           1(a). The Author grants permission to include their submitted Essay (with subsequent edits as required), Promotional Biography and Headshot Image, hereinafter referred to as the Work, on this website (www.myelevatorpitchforgod.com) and in possible future anthologies that may be compiled, hereafter referred to as the Website and the Anthology, to be published in print, eBook and audiobook (PDF, Mobi, ePub, Audible) formats. Specifically, the Author grants the Publisher the right to reproduce the Work, prepare derivative works and products based on the Work, and distribute copies of the Work, notwithstanding the Author’s existing copyright in the Work.

           1(b). The Author grants the Publisher the right to use the Author’s chosen publication name, biographical material, and picture provided for advertising, promoting, or otherwise publicizing the Work, the Website, and the Anthology. As part of the same, Author grants the Publisher the right to edit any portraits of the Author as necessary to conform to the layout preferences of the Publisher (e.g., cropping, lighting adjustments, etc.).

          1(c). The Author grants the Publisher the right to edit or otherwise modify the Work to the extent required to bring the Work into conformity with the punctuation and grammar rules set forth in the Chicago Manual of Style. This right includes the Publisher’s right to use third-party editors to make final grammatical edits without the Author’s approval.

          1(d). The Author grants the Publisher the right to verbally read the Work at in-person events (e.g., speeches, lectures, etc.), virtual settings (e.g., podcast interviews, videos, etc.), and/or any other medium.

 

          1(e). The Author grants the Publisher the right to use the Work to promote other material associated with the Publisher. This includes but is not limited to other books, volumes, publications, or any other content produced or assembled by the Publisher, whether in print or virtual mediums.

 

          1(f). The Author acknowledges that Publisher may seek other avenues for promotion of the Website, Anthology, or portions thereof, including the Work, with third parties, such as film producers (e.g., Netflix), podcast, and other entertainment or content-creating entities, as a way to promote additional opportunities relating to the Website or Anthology. 

 

          1(g). The Author acknowledges that Publisher may publish the Anthology, and consequently, the Work, in non-English languages. The Author expressly grants the Publisher permission to translate the Work, without the Author’s approval, according to the Author’s sole discretion and good faith attempt to preserve the Author’s intended concept, language, or idea.

 

2.      Author’s Warranties and Indemnities.


           2(a). The Author represents and warrants they are the sole Author of the Work and that no other individual, publisher, or any other entity retains an exclusive license, exclusive right, or any other exclusive permission to publish, share, or otherwise use the Work. For the sake of clarity, this means the Author has not engaged in any prior agreements with respect to the Work that prohibits the Publisher from using the Work in the manner described herein. The Author also represents that, to the best of their knowledge, the Work does not contain any plagiarism, libelous material, is not in violation of any rights of privacy or any other rights of third persons (including exclusive rights described above), and does not violate any existing common law or statutory copyrights. The Author acknowledges that it may have previously produced content that is substantially or exactly similar to the Work and hereby grants Publisher full rights to publish the Work, notwithstanding the possibility that it has been previously published, whether in a word-for-word publication or a substantially similar iteration of the same.  

           2(b). The Author warrants that they are the person identified in the Submittal Form and agrees to indemnify and hold the Publisher harmless against claims or any judgement finally sustained that the Work contains misrepresentation, libel, plagiarism, and/or invasion of privacy.

 

          2(c). The Author agrees to hold Publisher harmless for any and all damages that may arise from any alleged reputational harm or otherwise by virtue of the Author’s association with any other author, contributor, or associate involved in the collection, publication, promotion, or review of the Website or Anthology.

 

         2(d). The Author agrees to hold Publisher harmless of the acts of third parties, including without limitation any third-party reproduction, distribution, or any other third-party use of the Work not authorized by the Author.

 

3.       Approval of Entire Contract

          In addition to the waivers, promises, and other assurances contained in this Agreement, the Author expressly approves and consents to: (1) the Publisher’s use and publication of the Work; (2) the Publisher’s use and publication of the promotional biography including Promotional Headline describing Author; (3) the Publisher’s use and publication of the photograph of the Author; and (4) the Publisher’s use and publication of the Work alongside other essays drafted by additional authors.

 

4.      Consideration.

 

          The Author agrees to forbear from bringing any claims against the Publisher in exchange for the Publisher’s inclusion of the Work in the Website or Anthology. The Publisher agrees to promote the Website or Anthology in good faith to increase the exposure of the Work to the best of the Publisher’s ability.


          This agreement shall be interpreted under the laws of the State of California in the United States of America.

 

          By checking the box that says, “Check this box that you understand our Terms and Conditions,” you are in fact signing this contract, acknowledging that each party, the Publisher and the Author, has read and understood this contract, and had the opportunity to ask questions, prior to execution. This contract is in effect as of the date of clicking the “Submit” button under the Submittal Form...
